Energizer Loses ITC Patent Dispute Vs. Chinese Battery Makers

Law360, New York (October 5, 2004, 12:00 AM EDT) -- Chinese battery makers have fought back a patent challenge by a unit of industry leader Energizer Inc. at the U.S. International Trade Commission.

Energizer Holdings, which owns the Eveready Battery Co., filed a complaint in late April last year, asking the trade panel to bar a long list of competitors from importing and selling various household-sized alkaline batteries in the U.S.

But on Tuesday, the ITC rejected Energizer’s complaint in a decision that allows the Chinese battery manufacturers to continue exporting their batteries. The 28 respondents...
