Inside Fed. Circ.’s Due Process Analysis

Law360, New York (March 30, 2011, 12:32 PM EDT) -- Through its Feb. 18 panel decision in In re Katz Interactive Call Processing Patent Litigation, the U.S. Court of Appeals for the Federal Circuit provided a glimpse on how the court will resolve issues involving the tension between restrictive district court case management procedures and the parties’ due process rights. While this opinion addresses a fairly narrow set of facts, it constitutes an important step forward in the Federal Circuit’s development of its due process jurisprudence.
