Bayer Birth Control Patents Mostly Survive UK Suit

Law360, New York (March 17, 2011, 7:17 PM EDT) -- A British court largely upheld two Bayer Schering Pharma AG oral contraceptive patents Thursday but invalidated part of one patent based on prior art in a case brought Hungarian pharmaceutical company Gedeon Richter PLC.

Justice Christopher Floyd of the High Court of Justice's Patents Court agreed that two claims of one of the two related, divisional patents were invalid for obviousness but rejected similar allegations about other key claims in the patents.
