Ex-Isilon CFO Loses Bid To Toss SEC Case

Law360, New York (March 17, 2011, 11:19 PM EDT) -- A Washington federal judge on Thursday declined to toss a U.S. Securities and Exchange Commission suit that accuses the former chief financial officer of data-storage company Isilon Systems Inc. of misstating revenues.

The evidence about defendant Stuart W. Fuhlendorf's state of mind was not conclusive, Judge Marsha J. Pechman of the U.S. District Court for the Western District of Washington said in an order denying Fuhlendorf's motion for summary judgment.
