Arch Breached E&O Policy Sold To Lafayette Life: Judge

Law360, New York (March 22, 2011, 4:33 PM EDT) -- An Indiana federal judge ruled Monday that Arch Insurance Co. breached an errors and omissions policy issued to Lafayette Insurance Co. on claims stemming from litigation over a “bad apple” agent's allegedly deceptive sales practices.

Arch breached the insurance contract and is liable as to 12 of 21 policy claims brought by Lafayette, Judge Robert L. Miller Jr. ruled in the U.S. District Court for the Northern District of Indiana., adding that further discovery is required as to the remaining claims.
