Wis. High Court Rejects Challenge To Water Permit

Law360, New York (March 23, 2011, 6:53 PM EDT) -- Wisconsin's highest court ruled Wednesday that its state courts cannot use federal law to overturn water pollution permits, dealing a blow to environmental plaintiffs.

The Supreme Court of Wisconsin voted 5-2 to deny environmental groups' bid to use state courts to force the state to reconsider a permit it issued to a Georgia-Pacific tissue paper plant under the federal Clean Water Act permitting system. The decision overturns an intermediate appellate court ruling that the state judiciary should have some say on permits issued under CWA rules....
