ITC Takes Up 337 Probe Of Merck's NuvaRing

Law360, New York (March 24, 2011, 7:49 PM EDT) -- The U.S. International Trade Commission launched a probe Wednesday into Femina Pharma Inc.'s allegations that Merck & Co Inc., CVS Caremark Corp., Wal-Mart Stores Inc. and several others infringe its patent by importing Merck's NuvaRing vaginal ring birth control devices.

The ITC voted to institute its investigation based on Femina Pharma's Feb. 25 complaint alleging the respondents violated Section 337 of the Tariff Act of 1930 in the importation and sale of certain vaginal ring birth control devices that infringe U.S. Patent Number 6,086,909.
