Fla. House Committee OKs Malpractice Cap Bill

Law360, New York (March 25, 2011, 8:07 PM EDT) -- A Florida House of Representatives committee approved a bill Thursday that limits the damages awarded for pain and suffering to $300,000 in Medicaid malpractice cases in which health care providers are found negligent.

The proposed legislation, passed by the House Appropriations Committee, caps the award in a noneconomic Medicare malpractice suit at $300,000 per patient, irrespective of the number of physicians or other health care providers involved. A medical practitioner would not be liable for more than $200,000, regardless of the number of claimants.
