Tyco Healthcare Unit Sues J&J Unit Over Surgical Scalpel Patents

Law360, New York (October 11, 2004, 12:00 AM EDT) -- A unit of Tyco International Ltd. has sued Johnson & Johnson unit Ethicon Endo-Surgery, Inc. for patent infringement of a scalpel used in surgeries.

The lawsuit, filed by the U.S. Surgical Division of Tyco Healthcare Group LP in the U.S. District Court for the District of Connecticut, claims that Ethicon's Ultracision Harmonic Scalpel Curved Blade surgical instrument infringes multiple claims of four separate patents assigned to U.S. Surgical.

The patents in question -- U.S. Patent Numbers 6,063,050, 6,280,407, 6,468,286 and 6,682,544 -- generally relate to ultrasonic...
