Fed. Circ. Revives Watson Challenge Of Seasonique IP

Law360 (March 28, 2011, 2:48 PM EDT) -- The Federal Circuit reversed a summary judgment win for Teva Women's Health Inc. on Friday, reviving Watson Laboratories Inc.'s challenge to the validity of a patent covering oral contraceptive Seasonique.

A three-judge panel of the U.S. Court of Appeals for the Federal Circuit issued a nonprecedential ruling agreeing with Watson's claim that a lower court incorrectly granted summary judgment of nonobviousness, remanding the case for further proceedings.
