BP Engineer's Emails To Wife Not Privileged: Judge

Law360, New York (March 28, 2011, 7:02 PM EDT) -- Plaintiffs suing BP PLC over the Deepwater Horizon disaster can use emails sent between a BP engineer and his wife to push their case, a magistrate judge in Louisiana ruled Monday.

The marital privilege doctrine does not protect emails sent using BP computers, because the oil company warned its employees that their emails were BP property and not private, Judge Sally Shushan of the U.S. District Court for the Eastern District of Louisiana ruled.

The order affects all cases in multidistrict litigation over the April 2010...
