House Passes Bill To Exempt Pesticides From CWA

Law360, New York (March 31, 2011, 5:52 PM EDT) -- The U.S. House of Representatives passed a bill on Thursday aimed at overturning a Sixth Circuit decision that subjected pesticides to the Clean Water Act's permitting program.

The bill, known as the Reducing Regulatory Burdens Act, was approved by a 292-130 vote. No companion legislation has moved forward yet in the U.S. Senate.

Under the bill, the Federal Insecticide, Fungicide and Rodenticide Act and the Clean Water Act would both be amended to eliminate the requirement of a National Pollutant Discharge Elimination System permit for pesticides...
