The FTC And State Health Care Regulation

Law360 (April 6, 2011, 11:25 AM EDT) -- The Federal Trade Commission is very interested in state health care regulatory activity, and it is possible that, in some cases, concern for possible effects on competition leads the FTC staff to give insufficient deference to self-regulating health care professionals. A brief survey of recent FTC interaction with state health care regulatory authorities at least confirms the FTC staff’s approach in this regard.
