Judge Denies Bank's Injunction Bid In Durbin Suit

Law360, New York (April 4, 2011, 9:37 PM EDT) -- A South Dakota federal judge on Monday denied TCF National Bank's request for an order barring enforcement of the Durbin amendment to the Dodd-Frank Wall Street Reform and Consumer Protection Act that limits financial institutions' debit transaction fees.

In a hearing in the U.S. District Court for the District of South Dakota, Judge Lawrence L. Piersol denied the bank's motion for a preliminary injunction against the amendment, which aims to prevent credit card companies from using their market power to charge interchange fees.
