7th Circ. Revives Race Bias Suit Against Ind. Coroner

Law360, New York (April 5, 2011, 4:39 PM EDT) -- The Seventh Circuit revived a lawsuit Tuesday in which doctors who performed autopsies for the Marion County, Ind., coroner's office accused officials of terminating their employment contract as part of a plot to replace white workers with blacks.

The U.S. Court of Appeals for the Seventh Circuit ruled that a lower court had erred in granting summary judgment to defendants Marion County, former coroner Kenneth Ackles and chief deputy coroner Alfarena Ballew, finding that a factual dispute remained over whether the decision was race-based.
