Flood Exclusion In The Wake Of Japan's Tsunami

Law360, New York (April 14, 2011, 2:16 PM EDT) -- In the months following the devastation caused by the earthquakes and tsunami in Japan, property insurers will begin to receive direct property damage and dependent property or contingent business interruption claims. In addressing these claims, property insurers will need to determine whether tsunami damage is excluded under flood exclusions that often do not explicitly mention tsunami. This article suggests some of the issues likely to be involved in this determination.
