Judge Orders Synergetics To Reply To Rival’s Claim

Law360, New York (April 30, 2007, 12:00 AM EDT) -- A federal judge has denied and granted in part Synergetics Inc.’s request for more time to respond to Peregrine Surgical Ltd.’s summary judgment motion in a patent infringement case over membrane erasers used in ophthalmic surgery.

Judge Catherine D. Perry found Wednesday in the U.S. District Court for the Eastern District of Missouri that additional discovery would be unnecessary in regard to one of Peregrine’s arguments in favor of its summary judgment motion, saying Peregrine’s device does not literally infringe Synergetics’ patent and cannot infringe under...
