Widows Appeal Toss Of Suit Over Miner Deaths

Law360, New York (April 6, 2011, 8:07 PM EDT) -- The widows of two West Virginia miners who died in a 2006 fire at a Massey Energy Co. subsidiary’s mine said Wednesday they are appealing a decision dismissing their lawsuit, which alleged that flawed government inspections of the mine led to the blast.

Delorice Bragg and Freda Hatfield, widows of miners Don Israel Bragg and Ellery Hatfield, are seeking to overturn a February decision in the U.S. District Court for the Southern District of West Virginia dismissing their negligence and wrongful death suit.
