Judge Tosses Challenge To FDA Supplement Rules

Law360, New York (April 6, 2011, 10:17 PM EDT) -- Dietary supplement makers and industry groups on Wednesday lost a Washington lawsuit over the constitutionality of the U.S. Food and Drug Administration's supplement regulations.

Judge Beryl A. Howell of the U.S. District Court for the District of Columbia granted summary judgment to the FDA, saying that the agency's rules on good manufacturing practices for the supplement industry are not too vague to be enforceable.

“Regulations need not achieve mathematical certainty or meticulous specificity,” Judge Howell said.
