Aventine Hits Green Plains With $48M Adversary Suit

Law360 (April 7, 2011, 4:59 PM EDT) -- A unit of reorganized ethanol producer Aventine Renewable Energy Inc. filed suit Wednesday in Delaware to recover as much as $28 million in payments to Green Plains Renewable Energy Inc. and $20 million the ethanol supplier allegedly owes under a railcar sublease.

Aventine lodged the adversary complaint in the U.S. Bankruptcy Court for the District of Delaware, claiming Green Plains and five of its subsidiaries are obligated to return tens of millions of dollars that Aventine paid for fuel-grade ethanol while it was insolvent.
