S. African Court Nixes Watchdog's SAB Brewery Case

Law360, New York (April 7, 2011, 6:05 PM EDT) -- South Africa's antitrust court nixed an enforcement case against South African Breweries Ltd. on Thursday, ruling that it lacked jurisdiction to hear a case that exceeded the concerns raised by an alcohol retailer over the brewer's distribution practices.

The Competition Tribunal dismissed a minimum resale price maintenance case the country's Competition Commission brought against SAB and a slew of its distributors in 2007 based on several recent appellate decisions limiting the watchdog's ability to target companies for anti-competitive conduct covered by a complaint brought to the...
