Brooke's $18M Counterclaim Against Banks Survives

Law360 (April 7, 2011, 5:38 PM EDT) -- A Kansas federal judge declined Thursday to toss Brooke Holdings Inc.'s $18 million counterclaim against two banks and Textron Business Services Inc., which sued the insurance holding company to avoid liability related to securitized investments issued by bankrupt Brooke subsidiaries.

Ruling in the U.S. District Court for the District of Kansas, Judge Kathryn H. Vratil also denied a bid by third-party defendant FTI Consulting Inc. to have Brooke's claims of tortious interference with a contract thrown out.
