Peanut Co. Sues Fumigator Over $19M In Fire Damages

Law360, New York (April 8, 2011, 6:34 PM EDT) -- Severn Peanut Co. Inc. launched a negligence and breach of contract suit on Friday alleging Industrial Fumigant Co. is responsible for more than $19 million in damages after its efforts to fumigate Severn’s North Carolina storage facility in 2009 led to an explosion and fire.

The suit, lodged in the U.S. District Court for the Eastern District of North Carolina, alleges that Industrial Fumigant failed to properly use the pesticide in accordance with the Federal Insecticide Fungicide and Rodenticide Act and the North Carolina Pesticide Law....
