Infertility Claim Against Eli Lilly Dismissed

Law360, New York (May 1, 2007, 12:00 AM EDT) -- A district judge threw out the lawsuit of an infertile woman on Friday, saying she lacked evidence that her mother took the Eli Lilly and Co. miscarriage prevention drug that she alleged caused her condition.

Judge Royce C. Lambert ruled that Melissa Kelley failed to show enough evidence that her mother ingested the synthetic estrogen diethylstilbestrol, or DES, while she was pregnant with her in 1970 and 1971.

“What the plaintiff has provided is allegations and speculation with an assortment of seemingly related facts,” Lambert said...
