11th Circ. Nixes Injunction On Fla. Mining Permit

Law360 (April 11, 2011, 3:42 PM EDT) -- The Eleventh Circuit on Friday vacated a preliminary injunction preventing Mosaic Co. from advancing a phosphate mining project in central Florida, dealing a blow to the Sierra Club's suit alleging Clean Water Act violations.

The U.S. Court of Appeals for the Eleventh Circuit also set aside the U.S. District Court for the Middle District of Florida’s decision to remand a permit the U.S. Army Corps of Engineers issued for Mosaic’s mining project at the South Fort Meade Hardee County extension site.
