New Hampshire Data Law Ruled Unconstitutional

Law360, New York (May 1, 2007, 12:00 AM EDT) -- In a decision that could have far-reaching implications for the pharmaceutical industry, a U.S. district court judge has knocked down an unprecedented New Hampshire law that banned the commercial use of information on the drugs physicians prescribe.

On Monday, Judge Paul Barbadoro sided against the state in its battle with IMS Health Inc. and Verispan LLC, two data mining companies that collect prescription data from pharmacies, physicians, and hospitals and sell it to pharmaceutical companies, biotech firms, and government agencies.
