Braun Can't Dodge False Marking Claims On IV Fluids

Law360 (April 13, 2011, 4:18 PM EDT) -- Despite the heightened pleading standards for false marking whistleblowers set by a recent appeals court ruling, a  Pennsylvania federal judge on Tuesday refused to nix several claims that B. Braun Medical Inc. marked medical supplies with expired patents.

Judge Mary A. McLaughlin of the U.S. District Court for the Eastern District of Pennsylvania trimmed some claims from retired Philadelphia doctor Bentley A. Hollander's false marking suit, but found the majority of his claims against Braun could withstand the the pleading requirements laid out by the U.S....
