FDA Urged To Help Get Prandin Row To High Court

Law360, New York (April 13, 2011, 7:01 PM EDT) -- The Generic Pharmaceutical Association fired off a letter Monday urging the U.S. Food and Drug Administration to support a U.S. Supreme Court review of a patent dispute between Caraco Pharmaceutical Laboratories Ltd. and Novo Nordisk A/S over diabetes drug Prandin.

The generic-drug industry group's letter asks FDA Commissioner Margaret Hamburg to recommend that the U.S. solicitor general “forcefully support” Caraco's bid for the U.S. Supreme Court to take up its long-running dispute with Novo over the counterclaim provision of the Hatch-Waxman Act.
