Judge Rejects Further Relief In Mass. CWA Suit

Law360, New York (April 14, 2011, 6:57 PM EDT) -- A federal judge closed a Clean Water Act suit against the Massachusetts Department of Transportation on Thursday and rejected calls for further injunctive relief by environmental groups, saying the agency was complying with a previous remediation order.

Judge William G. Young of the U.S. District Court for the District of Massachusetts said the requested injunctive relief would require court oversight of MassDOT's funding, which could violate the state's authority, and would burden both the court and the state with additional layers of oversight.
