Judge Nixes Wis. County's Suit Over Union Law

Law360, New York (April 14, 2011, 7:17 PM EDT) -- A Wisconsin state judge on Thursday dismissed one of three suits challenging the controversial process Republican lawmakers used to pass a bill restricting the collective bargaining rights of most state employees.

"Under longstanding Wisconsin law, an agency or arm of government lacks authority to challenge the constitutionality of state statutes," Judge Maryann Sumi said in her opinion filed in the Circuit Court of Dane County, Wisconsin, dismissing the suit.
