Mo. Legislature OKs Bill To Cap Nuisance Damages

Law360, New York (April 15, 2011, 1:51 PM EDT) -- The Missouri Legislature on Thursday approved a bill that would place new restrictions on the recovery of damages in nuisance lawsuits against farms.

In a 110-45 vote, the Republican-controlled Missouri House passed H.R. 209, which limits compensatory damages awards for private nuisance claims involving agricultural property, sending the finalized bill to the governor.

The Missouri Senate passed an amended version of H.R. 209 on Tuesday. One Democrat joined nearly all the chamber’s Republicans to approve the new measure in a 24-7 vote.
