Patents Can Be Reissued To Narrow Claims: Fed. Circ.

Law360, New York (April 15, 2011, 6:31 PM EDT) -- The Federal Circuit ruled Friday that patent holders could file reissue applications solely to add narrower claims as a hedge against possible invalidity of the patent, reversing a ruling by a U.S. Patent and Trademark Office panel.

In a 2-1 decision, the U.S. Court of Appeals for the Federal Circuit held that the PTO's Board of Patent Appeals and Interferences erred when it found that patent holders were not allowed to file reissue applications that only added narrower claims.
