Enviros Want W.Va. CWA Suits Against Coal Cos. Coupled

Law360, New York (April 18, 2011, 6:42 PM EDT) -- Three conservation groups asked a West Virginia federal court Thursday to merge their Clean Water Act suit against a group of coal companies with a similar suit featuring overlapping defendants filed last month by the U.S. government.

The Sierra Club, the Ohio Valley Environmental Coalition Inc., and the West Virginia Highlands Conservancy Inc. are seeking to consolidate claims that Coal-Mac Inc. and other coal producers dumped selenium into public waterways with the government’s nearly identical claims against Coal-Mac and its affiliates.
