11th Circ. Backs Ruling In Mining Rights Dispute

Law360, New York (April 19, 2011, 9:27 PM EDT) -- The Eleventh Circuit on Tuesday upheld a ruling against Florida-based White Construction Co. Inc. in a suit claiming Martin Marietta Materials Inc. lured it into a mining rights agreement with false promises to buy some of its assets for $15.5 million.

The appeals court found the lower court was right to grant summary judgment to Martin Marietta on four of White's claims in the lawsuit, including the allegation that Martin Marietta had fraudulently induced the construction company into entering a contract that handed it mining rights...
