Fed. Circ. Nixes Cargill Win In Fertilizer IP Suit

Law360, New York (April 20, 2011, 6:43 PM EDT) -- The Federal Circuit on Wednesday reversed a win for Cargill Inc. and a former subsidiary in a suit accusing them of infringing a fertilizer-additive patent.

A three-judge panel overturned a judgment that Cargill Inc. and one-time subsidiary Mosaic Co. did not infringe a Specialty Fertilizer Products LLC patent, finding that the district court judge made errors in his claims construction.

“The district court incorrectly construed the claims,” Circuit Judge Kimberly A. Moore said, writing for the panel.
