Federal Circuit Upholds Dow, Monsanto Patent Victory

Law360 (May 4, 2007, 12:00 AM EDT) -- An appeals court has affirmed a ruling that chemicals manufacturers Monsanto Co. and the Dow Chemical Co. aren’t infringing three patents for genetically modified corn asserted by Swiss rival Syngenta AG.

The May 3 ruling from the U.S. Court of Appeals for the Federal Circuit was a blow to Syngenta’s Golden Valley, Minn.-based subsidiary, Syngenta Seeds Inc., which filed the lawsuit in July 2002 in Delaware District Court.
