Power Co-Op Can't Take Query To Okla. High Court

Law360, New York (April 22, 2011, 8:18 PM EDT) -- A federal judge said Friday he won't certify a question to Oklahoma's high court about the fiduciary relationship between Western Farmers Electric Cooperative and its members, in one member's suit accusing it of trying to monopolize the state energy market.

In an order denying WFEC member People's Electric Cooperative's motion to certify the question to the Oklahoma Supreme Court, U.S. District Judge Joe Heaton said despite the fact that the issue has not been resolved by the state courts, the "certification is unwarranted."
