USPTO Pushes To Reduce Re-Exam Delays

Law360, New York (April 25, 2011, 6:58 PM EDT) -- The U.S. Patent and Trademark Office on Monday proposed streamlining the process for patent re-examination matters in an effort to cut how long it takes to resolve disputes between patent owners and the public over the validity of issued patents.

The agency suggested new procedures for ex parte re-exams, which are between the patent holder and an examiner, as well as for inter partes re-exams, which allow a third party bringing the re-exam request to take part and rebut the patent holder’s arguments.
