Ex-Isilon CFO Calls Judge Biased, Seeks Mistrial

Law360, New York (April 25, 2011, 4:32 PM EDT) -- An Isilon Systems Inc. executive asked a Washington court Monday to declare a mistrial in a suit accusing him of misleading investors, saying the judge has shown favoritism toward the U.S. Securities and Exchange Commission through comments and her demeanor.

Stuart W. Fuhlendorf, who the SEC claims faked earnings through a series of sham transactions, said Judge Marsha J. Pechman revealed her bias when she suggested the defendant was “making [his] record for the court of appeals” by raising repeated objections.
