Del. Judge Pares $14M Wharf Contract Fraud Feud

Law360, New York (April 26, 2011, 7:33 PM EDT) -- A Delaware federal judge on Tuesday dismissed the lion's share of Kuhn Construction Co.'s contract dispute with a state-established entity over a $14 million bill for cost overruns tied to a wharf project in the Port of Wilmington.

Judge Sue L. Robinson dismissed substantive and procedural due process claims, a fraud and misrepresentation claim and a civil conspiracy claim, but allowed a breach of contract allegation to remain against Diamond State Port Corp., which owns and operates the Port of Wilmington.
