Merck To Abide By Discharge Diet To End Enviro Suit

Law360, New York (April 28, 2011, 6:16 PM EDT) -- Merck & Co. Inc. on Wednesday settled a water pollution suit in Virginia state court that codifies a cap on the amount of nitrogen and phosphorous pollution that can be discharged into South Fork Shenandoah River.

Under the settlement approved by Richmond Circuit Judge Melvin R. Hughes Jr., Merck will have to conform with a mandatory pollution diet, otherwise known as a total maximum daily load, that the U.S. Environmental Protection Agency recently put in place for the Chesapeake Bay watershed.
