8th Circ. Sides With DAP In Accidental Death Suit

Law360 (April 28, 2011, 5:02 PM EDT) -- The Eighth Circuit ruled Thursday that the Federal Hazardous Substances Act requires manufacturers to warn consumers only about their products' principal hazards, in a suit against DAP Inc. over a flammable cement product that caused a Missouri man's death.

In a published opinion, the appellate court affirmed a lower court's finding that DAP had not violated the FHSA by failing to instruct customers on how to handle an accidental spill of DAP's construction adhesive called Weldwood Gel Formula Contact Cement.
