Wash. Judge Denies Ex-Isilon CFO's Bid For Mistrial

Law360, New York (April 28, 2011, 4:00 PM EDT) -- A Washington state judge on Thursday denied an Isilon Systems Inc. executive’s motion for a mistrial in a suit over investor fraud at the data storage company, saying statements she made did not indicate she was biased toward the U.S. Securities and Exchange Commission.

Stuart W. Fuhlendorf — accused by the SEC of faking earnings through a series of sham transactions — said U.S. District Judge Marsha J. Pechman revealed her bias when she suggested the defendant was “making [his] record for the court of appeals”...
