7th Circ. Revives Waste Disposal Suit Against VIM

Law360, New York (May 3, 2011, 7:22 PM EDT) -- The Seventh Circuit on Tuesday revived a citizen suit accusing VIM Recycling Inc. of violating the Resource Conservation and Recovery Act by improperly disposing of waste at the company's Elkhart, Ind., facility.

The appeals court reversed a district court's decision to dismiss the case, ruling that the actions in Indiana court filed by the state environmental agency did not bar the citizen-plaintiffs' claims in federal court and remanding the case back to the Northern District of Indiana.
