7th Circ. Orders Near North Fraudster Sentence Review

Law360, New York (May 3, 2011, 6:48 PM EDT) -- The Seventh Circuit on Tuesday asked an Illinois federal judge to revisit whether a 121-month sentence handed to Near North Insurance Brokerage Inc. fraudster Michael Segal included punishment for honest services fraud, and to shorten it if it did.

Segal, who was initially indicted in 2002 and sentenced in October 2009, argued that his sentence was improper as a result of the U.S. Supreme Court's opinion in Skilling v. U.S., which trimmed the theory of honest services fraud so it only applies to a defendant involved...
