Tradebay, EBay Tangle Over Trademarks

Law360, New York (May 4, 2011, 4:29 PM EDT) -- Upstart online retailer Tradebay Inc. filed a declaratory judgment suit against eBay Inc. on Tuesday in Nevada, seeking a ruling that its name does not infringe eBay's trademark.

Tradebay has applied for a trademark on its name, and says that eBay has alleged that the Tradebay name is confusingly similar to that of the auction giant.

"Defendant has demanded that plaintiff permanently cease and desist from all uses of plaintiff’s approved mark or face legal action," the suit said. "Plaintiff is in reasonable apprehension of litigation,...
