7th Circ. Nixes Insurer's Appeal In Mall Fire Fight

Law360, New York (May 4, 2011, 7:39 PM EDT) -- The Seventh Circuit on Wednesday dismissed General Insurance Co. of America’s appeal of a decision that it must defend a Chicago mall in litigation over fire damages, finding a lower court mistakenly issued a final ruling in the fight.

General Insurance filed suit against the owners of the Discount Mega Mall in May 2008, seeking a declaratory judgment that it need not defend against claims related to fire damage caused to merchandise because of a policy exclusion.
