Fla. Law Gives Driver Error More Weight In Auto Suits

Law360, New York (May 4, 2011, 6:00 PM EDT) -- The Florida Legislature on Wednesday sent Gov. Rick Scott a bill that increases the difficulty for plaintiffs injured in an automobile accident to win liability damages from carmakers by requiring juries to consider a driver's error.

Under the bill, juries must weigh the fault of all those involved in an accident, such as the driver or other third parties, when deciding on damages in a product liability case and apportion fault among the responsible parties.
