Canada High Court To Hear Teva's Viagra Patent Appeal

Law360, New York (May 6, 2011, 7:14 PM EDT) -- The Supreme Court of Canada said Thursday it would hear Teva Canada Ltd.’s challenge to Pfizer Inc.’s patent for Viagra, in the latest bid by a Canadian drug maker to secure the right to produce a generic version of the erectile dysfunction drug.

The high court granted Teva Canada’s leave to appeal without comment Thursday, agreeing to review a September 2010 ruling from Canada’s Federal Court of Appeal that Teva Canada could not produce a generic version of Viagra until Pfizer’s Canadian patent expired in May...
