Texas House Advances 'Loser Pays' Tort Reform Bill

Law360, New York (May 9, 2011, 10:52 PM EDT) -- A proposal to create a so-called loser pays legal system strongly backed by Texas Gov. Rick Perry advanced out of the state's House of Representatives on Monday.

The bill, HB 274, would make it easier for civil lawsuits to be dismissed earlier, allow a winning party recover attorneys' fees in breach-of-contract suits barring a previous agreement over fees between the parties and create an expedited process for civil suits seeking less than $100,000.
